1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of skale.email, including our website at https://skale.email and the web application (the "Service"). The Service is owned and operated by Skalebuddy Software Pvt Ltd.

By creating an account, connecting a mailbox, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

skale.email provides email warmup, deliverability monitoring, and related tools that help teams improve inbox placement and sender reputation.

Features may include workspace management, mailbox connections, automated warmup scheduling, activity logs, domain health checks, and analytics. We may add, modify, or discontinue features at any time.

3. Account Registration

You must provide accurate and complete registration information and keep your account credentials secure.

You are responsible for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

We may suspend or refuse registration where we reasonably believe information is inaccurate, fraudulent, or abusive.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, phishing, malware, or unlawful content.
• Violate anti-spam laws such as CAN-SPAM, GDPR, or other applicable regulations.
• Impersonate another person or misrepresent your affiliation.
• Interfere with or disrupt the Service, other users, or connected mail providers.
• Reverse engineer, scrape, or attempt to gain unauthorized access to systems or data.
• Use the Service for any purpose that violates third-party terms, including your email provider's policies.

5. Mailbox Authorization

You may only connect mailboxes you own or are explicitly authorized to manage.

By connecting a mailbox, you grant us permission to access and process email and configuration data solely as needed to operate warmup, monitoring, and related features you enable.

You remain responsible for compliance with your email provider's acceptable use rules and for obtaining any consents required by law.

6. Plans, Billing & Trials

Certain features may be offered free of charge while others require a paid subscription. Pricing, limits, and plan details will be presented before purchase where applicable.

Paid subscriptions renew automatically unless cancelled before the renewal date. Taxes may apply based on your location.

We may change pricing or plan features with reasonable notice. Continued use after a pricing change constitutes acceptance unless you cancel.

7. Intellectual Property

The Service, including software, design, branding, documentation, and content provided by Skalebuddy Software Pvt Ltd, is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription or authorized free use.

You retain ownership of your data. You grant us a license to host, process, and display your data solely to provide and improve the Service.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, and factors outside our control may affect the Service.

We may temporarily suspend access for security, abuse prevention, or technical reasons, with notice where practicable.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

skale.email is a deliverability tool, not a guarantee of inbox placement. Results depend on many factors outside our control, including recipient systems and your sending practices.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKALEBUDDY SOFTWARE PVT LTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Skalebuddy Software Pvt Ltd, its affiliates, and personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your connected mailboxes, your content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time and may request account deletion through support.

We may suspend or terminate access if you breach these Terms, create risk for other users, or where required by law.

Upon termination, your right to use the Service ends. Provisions that by nature should survive — including payment obligations, disclaimers, liability limits, and indemnification — will survive.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory local consumer protections apply.

Disputes will be subject to the exclusive jurisdiction of courts located in India, unless applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.

If you continue using the Service after changes take effect, you accept the revised Terms.
